“criminal” is not an exclusive identity, it’s just a label for someone who happens to have committed a crime. You can be a criminal and a worthy part of society at the same time. Killing people almost always causes more misery than it removes.
Right, though Batman stories rarely depict ordinary people who just happen to commit a single crime. Criminals in that universe are all cackling psychopaths who wander the streets, assaulting, robbing, and murdering anyone they encounter. They’re much more aptly labeled villainous outlaw gangsters than mere criminals.

Yeah, and maybe it should be mentioned that Arkham City has a huge amount of political prisoners and other innocents inside of it.
Even in the context of the game, at some point, Batman is asked something like, “These are all criminals, should you really be helping them?” and Batman responds by pointing out that some of the inmates are political prisoners. Which is very applicable to real life, given how corrupt almost all justice systems in the world are.
